Ethics Channel

CAPSA FOOD has established Whistleblowing Channel for its employees, partners and third parties, as a tool to prevent and detect infringements.

CAPSA FOOD is firmly committed to an ethical culture and regulatory compliance within the Company; it rejects any conduct that does not adapt to the ethical standards established in the organisation and adopts the necessary measures to guarantee compliance of current legislation and to prevent crimes.

The Whistleblowing Channel can be used to report regulatory breaches or unethical practices, criminal behaviour, serious or very serious administrative infringements, and any beach of the European Union noted in CAPSA FOOD; the channel cannot be used for communications other than the aforementioned infringements or when there are other perpetrators; false allegations, those based on grounds that do not come under the Law, and those made with the sole intent of harm will be inadmissible.

The Whistleblowing Channel is not meant to deal with queries about our products or services. Therefore, CAPSA FOOD has a consumer support service, available through the 'Contact' section on the websites of our brands, or by telephone, using the consumer hotline shown on the labels of all our products.

The form that appears when accessing the channel allows users to submit their allegation anonymously or confidentially; in any event, whistleblowers are guaranteed protection against any type of reprisal.

Allegations reported through the Whistleblowing Channel will be processed according to the following fundamental principles:

  • Once you have submitted your allegation, whether anonymously or confidentially, we will send you an acknowledgement of receipt within 7 days.
  • The Compliance Committee is in charge of the Internal Information System and of the Whistleblowing Channel. However, CAPSA FOOD manages externally the communications received through the Channel, which will be sent to and processed by our legal advisors, VACIERO S.L.P., to ensure there will be no conflict of interest with the members of the Oversight body under any circumstances.
  • The allegations will lead, as applicable, to the respective internal investigation, which will be conducted with the strictest guarantees of confidentiality, secrecy and protection of the whistleblower. The internal investigation will also fully respect the presumption of innocence and for the honour of the people involved.
  • They will be informed when the investigation has ended. However, there will not be informed of the outcome or the ensuring measures that the company adopts regarding the people involved. Such measures will be directly processed with the competent authorities.
  • Allegations made through the whistleblowing channel are guaranteed not to lead any type of reprisal against the whistleblowers, in accordance with Act 2/2023, of 20 February, protecting people reporting legislative breaches and to fight against corruption.
  • Any communications that exceed the scope of the Act, those that are clearly false, manipulated or on grounds not envisaged in Law. Accordingly, CAPSA FOOD warns that such facts may led to civil or criminal, and disciplinary liabilities, in the terms envisaged in current legislation.
  • We inform you that you can request a personal interview with the Compliance Committee. In that case, we inform you that you cannot remain anonymous in the personal interview, but are guaranteed utmost confidentiality and secrecy.

Notwithstanding this internal channel, we likewise inform you that the different competent authorities and, as applicable, institutions, bodies or agencies of the European Union have communication channels through which to receive allegations regarding infringements within their jurisdiction.
